Enforcement officer not clear about smoking rule

“I saw this incident at Toa Payoh, where a man was issued with an notice about committing an offence under Section 3(2) Smoking (Prohibition in certain places) Acts, Chapter 310.
“One officer from NEA approached this man and instructed him to hand over his identity card so that he can issue notice of offence he had committed.
“This man asked for the officer’s identity pass but the officer refuse to show his identity card.
“The man asked the officer what offence he committed and the officer replied him that he was smoking on the NEA premises and thus had committed the offence under the Smoking Act Chapter 310.
“From the photos attached, we can see that the area that the man was smoking in neither belonged to the coffee shop nor the hawker center.
“A gentleman approached the officer with a lighted cigarette and asked whether did he committed the same offence.
“The officer replied that he did not commit the offence as he was standing but not if he was sitting.
“At this point, more patrons from the hawker center and coffee shop gathered and voiced their grievance for the man who was issued with the notice.
‘This set me wondering about what is stated in the Smoking Act.
“1) The temporary tables at that area were not marked with labels about whether they were for smoking or non-smoking patrons.
“2) The officer claimed that the area and tables are NEA premises which I am doubtful.
“The temporary tables are set by the coffee shops/hawker centre which does not belong to the NEA. The area neither belongs to the coffee shop nor hawker centre.
“3) The officer had carried out his duties in such an unprofessional way which triggered much unhappiness among the patrons and three police cars were called in to handle this issue.
“4) The officer was also unsure whether the man had committed the offence and even called up his superior before issuing the notice and giving the explanation that they had received orders/agenda from the top management to carry out such enforcement. "
An NEA spokesperson, when contacted, said:
""The incident happened on 6 Aug 08 at about 10:40pm when enforcement officers from CISCO (engaged by NEA) approached a customer sitting at one of the portable tables set up by stallholders outside Blk 93 Lor 4 Toa Payoh.
"This customer was seen smoking at the table even though it was not a designated smoking table. In light of this, he had committed a smoking offence.
"As the offender had refused to furnish his particulars, the enforcement officers had to request for police assistance.
"We understand that while awaiting for the arrival of the Police, the officers were surrounded by a crowd which soon dispersed when the Police arrived.
"We would like to advise your readers that smoking has been prohibited in all eating establishments, including hawker centres, to protect patrons from second-hand smoke since Jul 2006. Smoking is only allowed at designated smoking corners/areas.
"Operators of eating establishments are required to put up appropriate "no-smoking" signs, and we would need to count on smokers' cooperation to protect other patrons from second-hand smoke."

Obviously a biohazard disrupting the peace of a natural habits lifestyle.
just because u smoke doesnt mean its "natural"
you wann smoke, fine. just dont get in the way of non-smokers. non-smokers dont like food with tobacco favour-smell.
smokers have being selfish for a long time. walking and smoking on the road then throwing the cig on the floor.. that is littering right? littering fine has being here for a long time right? have u "littered" be4 then? have u paid the fines be4? is that the "natural" thing for smokers? or u wann say.. littering is "natural"?
you have your smoking rights of course. just dont get into the way of non-smokers, thus u have a yellow box where u k smoke and not disturb the smell sense of non smokers. i believes that's fair enough for both sides. if u're so upright den pay up all the fine for "littering".

It's purely nonsense. NEA itself just wants to fine smokers. Very obvious reasons. It's like smokers are criminals even when they pay tobacco taxes.
Should the non smoker gets a fine too for sitting next to designated smoking area?

It's purely nonsense. NEA itself just wants to fine smokers. Very obvious reasons. It's like smokers are criminals even when they pay tobacco taxes.
2nd hand smoke? Whats the difference between a yellow designated line box and the next table is a non smoking zone. How do you argue on this issue of 2nd hand smoke for smokers sitting inside the yellow box and blowing his smoke to the next non smoking zone. Should the non smoker gets a fine too for sitting next to designated smoking area? The More I See It, its very plain stupidity and NEA purely wants to fine smokers. Very obvious reasons. Also, what the difference between sitting and standing outside the eating establishment and meteres apart? Can the guy says that, I dont like to sit with those crowds inside coffeeshop against the law? So what is the difference between a guy standing and not getting fine next to the table while the other gets fine while sitting? A double standard practise and I really see that the law flaws. Its obvious NEA is not out to educate but just fining smokers as they pleases.
On the contrary, the NEA officer should not hide his identity even he claims he is the enforcement representative. Whats so secretive about showing his damm pass and identifying yourself? Is he not proud of his profession but trying to show off his authority? Is NEA outsourcing scare tactics?

Its like somebody knocking on your door and barge into your house without any evidence that they are authorise to do so. Even the police needs search warrant.
You mentioned police need search warrant to search yr premises that is correct as it is a confined and personal space you are refering here.
If a police officer in full uniform with side-arm asking for your nric do you ask him for his warrant card? Please lah. Use common sense again.
If you think he or the policeman is fake, what make u think showing you his pass is not fake? by the way he is alone like any other enforcement officer who can be easily be beaten up anytime.

The NEA or CISCO guy calls for the POLICE for assist... just because you want to issue a ticket to this poor fellow for smoking??? Don,t you think the Police has more important things to do... This calling of the police, should NOT and NEVER have taken place, should you simpily show and produce your ID and identify yourslef.
In my opinion you are just another big ass........ wasting the time of being alive. I hope you read this and immediately "Hara kiri" what atotal waste of tax payers money.

If you are in the officer's shoes, after showing him yr pass and he refuse to show you his NRIC what will you do?
Not every citizen is cooperative and i have seen many cases in coffeeshop where ppl try to create problem for police as they know they have limited powers over non serious crime matters. These officers cant do anything and ppl laugh at them. How will they feel?
Put yrself in their shoes before saying non constructive comments. If it is regarding their bad manners and attitude i will support you.

No offcial identity card - clearly the asshole NEA guy is at wrong.
What smoking act? An sct to squeeze $ when the world economy is in recession. $ no enough.

This should not have happened if the CISCO officer show his identity card in the first place.

How to explain that?
If you are in the officer's shoes, after showing him yr pass and he refuse to show you his NRIC what will you do?
